SERVICE AGREEMENT AND WAIVER OF LIABILITY

This Service Agreement (the “Agreement”) is made and entered into by and between *Armadillo Automotive and Powdercoating located at 1414 Fulton Street, Kenner, LA  (“Armadillo Auto” or “Company”) and the undersigned customer (“Customer”)

1. Authorization for Services
The Customer hereby authorizes Armadillo Auto to perform repair and maintenance services (“Services”) on the Customer’s vehicle, including the use of materials, parts, and any other necessary components, in accordance with the estimate or instructions provided.

2. Waiver of Liability
The Customer acknowledges and agrees that:

  • Armadillo Auto is not responsible for any loss, theft, or damage to the Customer’s vehicle or any personal belongings left within the vehicle.
  • The Company is not responsible for any damage incurred due to loading or unloading of any items in or out of the vehicle.
  • Armadillo Auto shall not be liable for any delays in Services due to the unavailability of parts or delays caused by third-party suppliers.
  • Armadillo is not responsible for damage due to flooding or other Acts of God.
  • Armadillo is not responsible for delays in receiving parts and, as such, cannot be held liable for any rental car charges incurred due to prolonged wait times for parts.

3. Mechanic’s Lien 
An express Mechanic’s Lien is hereby granted to Armadillo Auto on the Customer’s vehicle to secure payment for all Services performed. The Customer agrees that Armadillo Auto may retain possession of the vehicle until full payment is received.

4. Non-Refundable Deposit
The Customer agrees to provide a non-refundable deposit prior to the commencement of any Services as stipulated by Armadillo Auto. This deposit is required to secure the Customer’s appointment and allocate resources for the requested Services. A new appointment must be made if the customer cancels their service.

5. Estimates and Adjustments
The estimate provided is a preliminary assessment. The Customer acknowledges that final costs may vary depending on the condition of the vehicle upon arrival and any additional Services required to complete the work.

6. Payment Terms and Storage Fees
Payment in full is due upon completion of Services. If the Customer fails to retrieve the vehicle or any associated items within five (5) days of completion, a daily storage fee will apply until the vehicle is picked up.

7. Abandonment and Transfer of Ownership
If the Customer fails to retrieve the vehicle or any associated items within forty-five (45) days of service completion, the vehicle or items will be deemed abandoned and will become the property of Armadillo Auto without further notice or compensation to the Customer.

8. Powder Coating and Related Services
For powder coating or any high-heat treatment:

  • The Customer acknowledges that heat and chemical treatments may damage certain materials, and Armadillo Auto is not liable for damages that may occur during such processes.
  • The Customer is responsible for ensuring that any items undergoing powder coating are free from grease, seals, bearings, or any sensitive materials that could be damaged by the treatment.
  • The Customer must have the final say on power and paint colors before the service will commence.

9. Testing and Operation of Vehicle
The Customer grants Armadillo Auto permission to operate the vehicle on streets, roads, or highways as necessary for testing and inspection purposes. Additionally, all breathalyzers installed in the vehicle must be disabled prior to service

10. Fuel and Additional Charges
If the vehicle requires fuel for testing or movement, an additional fuel surcharge of $20 plus the cost of gas will apply. In cases where the vehicle must be pushed or pulled within the shop, an additional fee of $125 may be charged.

11. Failure to Pay and Collections
If payment for completed Services is not received, Armadillo Auto reserves the right to take collection actions, which may include sending a demand letter. All collection costs, including attorney’s fees, will be the responsibility of the Customer.

12. Owner Supplied Parts
Armadillo is happy to accept owner-supplied parts; however, please note that these parts will not be covered under warranty. Only parts ordered directly by Armadillo are eligible for warranty coverage.
